TERMS AND CONDITIONS

  1. Company Information

1.1 This mobile application (“App”) is operated by After Pierce Labs LTD (“Company”, “we”, “us”, “our”).

  1. Acceptance of Terms

2.1 By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions (“Terms”).

2.2 If you do not agree to these Terms, you must not use the App.

2.3 We reserve the right to update or amend these Terms at any time. Continued use of the App constitutes acceptance of any updated Terms.

  1. Eligibility

3.1 You must be at least 16 years old to use the App.

3.2 By using the App, you confirm that you:
(a) meet this age requirement; and
(b) have the legal capacity to enter into a binding agreement.

3.3 We may suspend or terminate access where we reasonably believe these requirements are not met.

  1. The App

4.1 The App provides features including, but not limited to:
(a) QR code scanning;
(b) points accumulation;
(c) reward redemption; and
(d) promotions and offers.

4.2 We do not guarantee that the App will always be available, uninterrupted, or error-free.

4.3 We reserve the right to modify, suspend, or discontinue any part of the App at any time.

  1. Points and Rewards

5.1 The App operates a promotional loyalty scheme (“Points”).

5.2 Points are awarded at our sole discretion.

5.3 Points:
(a) have no cash value;
(b) do not constitute stored value; and
(c) cannot be transferred, refunded, or exchanged for money.

5.4 Points may be awarded for qualifying transactions or activities as determined by us.

5.5 Points must be collected at the time of purchase using the App or authorised QR code process.

5.6 Points will not be issued retrospectively.

5.7 We may remove, adjust, or cancel Points at any time, including where:
(a) a transaction is refunded;
(b) Points were issued in error; or
(c) misuse or fraud is suspected.

5.8 Points may expire in accordance with rules determined by us.

5.9 Points may be redeemed for selected in-store products or services, subject to availability.

5.10 We reserve the right to amend, substitute, or withdraw rewards at any time.

5.11 Points do not create any contractual right or entitlement.

5.12 Any attempt to manipulate or exploit the Points system is strictly prohibited and may result in removal of Points and suspension or termination of the account.

  1. QR Code Usage

6.1 QR codes must be scanned at the time of purchase.

6.2 We are not responsible for missed, failed, or delayed scans.

6.3 Points will not be issued retrospectively under any circumstances.

6.4 Misuse of QR codes may result in Points removal, account suspension, or termination.

  1. User Conduct

7.1 You must use the App lawfully and responsibly.

7.2 You must not:
(a) engage in fraudulent activity;
(b) attempt to exploit or manipulate the App or Points system;
(c) create or use multiple accounts;
(d) interfere with the operation or security of the App; or
(e) behave in a manner that is abusive, threatening, or inappropriate towards staff.

7.3 We may suspend or terminate accounts where a breach of this section is reasonably suspected.

  1. Payments and Subscriptions

8.1 The App may offer paid features or subscriptions.

8.2 All pricing and terms will be clearly presented prior to purchase.

8.3 Subscriptions may automatically renew unless cancelled in accordance with the relevant terms.

8.4 Fees are non-refundable except where required by applicable law.

  1. Returns and Refunds

9.1 All in-store purchases are non-refundable except where required by applicable law.

9.2 Where a product is faulty, not as described, or unfit for purpose, your statutory rights apply.

9.3 Due to hygiene and safety reasons, we do not accept returns or exchanges on jewellery, hair products, or similar items once purchased, regardless of whether the item has been opened or used.

9.4 This policy is strictly enforced in the interests of health, safety, and customer protection.

9.5 Where we choose, at our sole discretion, to provide a refund or goodwill gesture for a non-faulty item, this will be issued in the form of Points only.

9.6 We reserve the right to refuse any return or refund where no legal obligation exists.

9.7 Nothing in these Terms affects your statutory rights.

  1. Intellectual Property

10.1 All intellectual property rights in the App are owned by or licensed to the Company.

10.2 You are granted a limited, non-exclusive, non-transferable licence to use the App for personal use only.

10.3 You must not copy, reproduce, modify, distribute, or otherwise exploit any part of the App.

  1. Limitation of Liability

11.1 The App is provided on an “as is” and “as available” basis.

11.2 To the fullest extent permitted by law, we shall not be liable for:
(a) loss of Points;
(b) App downtime or technical issues;
(c) unavailable products, services, or rewards; or
(d) any indirect or consequential loss.

11.3 Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

  1. Data Protection

12.1 We process personal data in accordance with applicable data protection laws.

12.2 Full details of how personal data is collected, used, and protected are set out in our Privacy Policy.

  1. Termination

13.1 We may suspend, restrict, or terminate access to the App at any time, with or without notice.

13.2 This includes where we reasonably believe there has been:
(a) fraud;
(b) misuse of the App;
(c) multiple account use;
(d) harmful or unlawful content; or
(e) behaviour that poses a risk to staff, the Company, or other users.

13.3 Upon termination:
(a) access to the App will be withdrawn; and
(b) any accumulated Points may be cancelled without compensation.

13.4 Our decision in relation to termination shall be final.

  1. Identification and Medical Requirements

14.1 The App does not constitute valid identification.

14.2 Valid, in-date, government-issued photographic identification may be required in-store.

14.3 We reserve the right to refuse service where appropriate identification is not provided.

14.4 All services remain subject to medical suitability at the time of attendance.

14.5 We may refuse to provide any service where we reasonably believe that doing so may pose a risk to health or safety.

14.6 The awarding of Points or rewards does not guarantee that a service will be provided.

14.7 Refusal of service on medical or safety grounds shall not constitute a breach of these Terms.

  1. User Content and Communications

15.1 Users may submit content through the App, including messages, support requests, and images.

15.2 You confirm that you have the necessary rights to submit such content and that it does not infringe the rights of any third party.

15.3 We reserve the right to review, remove, or restrict any content at our discretion.

15.4 Any complaints relating to the App, products, or services should be submitted through the App using the designated support or ticketing feature.

15.5 Users are encouraged to provide full and accurate details to allow the Company to investigate and respond appropriately.

15.6 The Company will make reasonable efforts to respond to complaints within a reasonable timeframe.

15.7 The requirement to submit complaints through the App is intended to ensure efficient handling and record-keeping, but does not affect any statutory rights or the ability to pursue a claim through other legal means.

15.8 Complaints not submitted through the App may not be prioritised.

  1. Availability

16.1 All products, services, and rewards are subject to availability.

16.2 We do not guarantee availability at any given time.

16.3 The unavailability of any product, service, or reward shall not constitute a breach of these Terms.

16.4 Images, descriptions, and promotional materials are for illustrative purposes only.

  1. Accounts

17.1 Each user is permitted to create and maintain one account only.

17.2 The creation or use of multiple accounts is prohibited.

17.3 We reserve the right to merge, suspend, or delete duplicate accounts and remove any associated Points or rewards.

17.4 You are responsible for ensuring that all account information is accurate and up to date.

  1. General

18.1 These Terms constitute the entire agreement between you and the Company.

18.2 If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

18.3 Failure to enforce any right shall not constitute a waiver of that right.

18.4 We may assign or transfer our rights under these Terms without notice.

18.5 We shall not be liable for any failure or delay resulting from events beyond our reasonable control.

19.1 These Terms are governed by the laws of England and Wales.
